Terms of Use

These Terms of Use ("Terms") govern your use of the Ananda Manifest & Affirmation mobile app (the "App") and our website and blog (the "Website"), provided byAnanda Manifest & Affirmation ("we", "us", or "our"). By downloading, accessing or using the App, you agree to these Terms. If you do not agree, do not use the App. By using the Website, you agree to the parts of these Terms that apply to it (Sections 5, 10 to 15 and 18 to 21). Our Privacy Policy explains how we handle your information.

1. Eligibility & Your Account

You must be at least 13 years old, or the minimum age of digital consent in your country if that is higher, to use the App. If you are under the age of majority where you live, you may use the App only with the permission of a parent or guardian.

The App has no sign-up. It creates an anonymous account the first time you save your details in Settings (see ourPrivacy Policy). If you reinstall the App on the same device, your account is normally reconnected: through the iOS Keychain on iOS, and through a hashed device identifier on Android. Your account cannot be recovered after a factory reset, on a different device, or if that information is lost. An active subscription can still be restored with "Restore Purchases" on the App's subscription screen.

2. License to Use the App

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on devices you own or control, for your personal, non-commercial use. You may not rent, sell, lend or sublicense the App.

3. Your Content ("Personal Essence")

You can enter your name and short answers about your accomplishments, challenges and goals ("Personal Essence") so the App can write personalized affirmations for you. You keep ownership of what you enter. You grant us a worldwide, royalty-free license to store, process and transmit it, including to our AI provider as described in ourPrivacy Policy, only to operate the App and provide its features to you. We do not use your content to train AI models.

You are responsible for what you enter. Do not enter content that is unlawful or infringes anyone's rights, private information about other people, or sensitive information you don't want processed by an AI service.

4. AI-Generated Content & Wellbeing Disclaimer

Affirmations in the App are generated by artificial intelligence from the information you provide. The App only sends your information to our AI provider after you allow it on the "Your Data & AI" screen, and you can change that choice at any time in Settings → Privacy & Safety. If you don't allow it, the App can't write new affirmations for you. Affirmations are meant for general motivation and self-reflection only. They are not medical, psychological, financial or legal advice, and they are not a substitute for professional care. Manifestation content describes a mindset practice and does not promise any particular result.

AI-generated text may sometimes be inaccurate, repetitive, unsuitable for your situation or, rarely, inappropriate. If you see an affirmation that seems harmful, offensive or inappropriate, please report it withReport a problem in Settings → Privacy & Safety, or contact us (seeContact Us). We review reports and use them to improve the App.If you are in crisis or thinking about harming yourself, contact your local emergency services or a crisis helpline right away.

You may use the affirmations generated for you for any personal purpose. Because they are generated by AI, similar text may be generated for other users.

5. The Website & Blog

General information only. Articles and other content on the Website are for general information and inspiration. Where they describe research, they summarize it in plain language, which means simplifying it. Research can change, and we don't promise that any article is complete, current or right for your situation. Website content is not medical, psychological, financial or legal advice, and it is not a substitute for professional care. Don't delay seeking professional help because of something you read on the Website. If you are in crisis or thinking about harming yourself, contact your local emergency services or a crisis helpline right away.

Using our content. You're welcome to read and share links to our articles, to quote short excerpts with credit and a link back to the original article, and to use the affirmations published on the Website for your own personal, non-commercial use. You may not republish whole articles, or use our content to build a competing product or service, or for any other commercial purpose, without our written permission.

Links. The Website links to third-party websites, including research sources, the App Store and Google Play. We don't control those sites and are not responsible for their content or privacy practices.

Availability. We provide the Website free of charge and may change, update or remove any part of it at any time.

6. Free Features, Subscriptions & Purchases

Free features. Some features are free with limits. Currently, these are one free affirmation generation per device and a limited number of profile saves. Limits apply per device and per account, including after you reinstall the App or use Delete My Data. We may change free features and limits.

Premium. Optional auto-renewing subscriptions, and any one-time purchases we offer, unlock additional features ("Premium Features"), such as a new set of affirmations each day, unlimited profile saves, and backup and restore of your favorites. The App shows each product's title, length, price and features before you buy.

• Payment: payment is charged to your Apple ID or Google Play account when you confirm the purchase.
• Auto-renewal: subscriptions renew automatically for the same length and price unless auto-renew is turned off at least 24 hours before the end of the current period.
• Renewal charge: your account is charged for renewal within 24 hours before the end of the current period, at the price shown when you subscribed unless you were told about a price change.
• Managing and cancelling: manage or cancel your subscription at any time in your Apple ID subscription settings (iOS) or Google Play's Subscriptions page (Android). Cancelling stops future renewals. You keep access until the end of the period you have paid for, and the current period is not refunded.
• Free trials: if a free trial is offered, it converts to a paid subscription unless you cancel before it ends (on the App Store, at least 24 hours before it ends). Any unused part of a free trial ends when you buy a subscription.
• Price changes: Apple or Google will notify you of any price change under their rules, and may ask you to agree to it before it applies.
• Restoring purchases: use "Restore Purchases" on the App's subscription screen to restore an active subscription, for example on a new device.
• Deleting is not cancelling: deleting your data or uninstalling the App does not cancel a subscription.

7. Refunds

All purchases in the App are billed and processed by Apple (App Store) or Google (Google Play), and refunds are handled under their policies:

• Apple App Store: request a refund atreportaproblem.apple.com. Apple decides App Store refunds, and we cannot issue them.
• Google Play: request a refund through yourGoogle Play order historyor Google Play Help. If Google refers you to us, contact us and we will review your request in line with Google Play's policies and applicable law.

We never have access to your payment card details. When you ask Apple for a refund, Apple may ask us for information about the purchase; see Section 8. Nothing in these Terms affects any rights you have under consumer protection law that cannot be excluded.

8. Refund Requests & Data Sharing with Apple

We use the subscription platform Adapty to manage purchases. We also use its Refund Saver feature to answer Apple's information requests when someone asks Apple for a refund of an in-app purchase.

By making a purchase in the App on iOS, you agree that we may, through Adapty, send Apple the information described in Section 7.3 of our Privacy Policy, together with our preference on whether the refund should be granted. That information includes, for example, the time since you installed the App, your total time using the App, how much of the purchase was used, and the amounts you've spent and had refunded. Apple alone decides whether to grant the refund. We share this information only to answer that refund request, and never for advertising. You can withdraw your consent at any time by contacting us as described in that section. Withdrawing does not affect your right to request a refund.

9. Acceptable Use

You agree not to:

• use the App for any unlawful purpose or in violation of these Terms;
• reverse-engineer, decompile or extract the App's source code, except where the law allows it;
• interfere with, overload or bypass the App's rate limits, security or authentication;
• use bots, scripts, emulators or multiple accounts to get extra free generations or otherwise avoid free-tier limits or payment, including by tampering with device identifiers or modifying the App;
• enter content that is illegal, abusive or infringes the rights of others; or
• send false, abusive or automated reports through Report a problem.

To protect the service, we may restrict the App on devices that appear to be emulated, rooted, jailbroken or running a modified copy of the App.

10. Third-Party Services

The App relies on third-party services, including Supabase (backend hosting), OpenAI (AI affirmation writing) and Adapty (subscription management), and the Website is hosted on GitHub Pages; see ourPrivacy Policy. We are not responsible for third-party services. Your use of the App Store or Google Play is also governed by Apple's or Google's own terms.

11. Intellectual Property

The App and the Website, including their design, branding, articles, text, graphics and software, are owned by us or our licensors and protected by intellectual property laws. This does not include your own content or the affirmations generated for you. You may not copy, modify, distribute or create derivative works from the App or the Website except as these Terms allow. If you send us feedback or suggestions, we may use them without any obligation to you.

12. Changes, Suspension & Termination

We may change, suspend or discontinue the App or any feature. We may suspend or end your access if you break these Terms, or where needed to protect the App, other users or the law. You may stop using the App at any time and delete your data as described in Section 9 of our Privacy Policy. Remember to cancel any subscription separately. Sections 3, 4, 5, 11 and 13 to 20 continue to apply after your use of the App ends.

13. Disclaimer of Warranties

To the extent the law allows, the App and the Website are provided "as is" and "as available", without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the App or the Website will be uninterrupted or error-free, or that AI-generated content or Website articles will be accurate, complete or suitable for your needs. Some jurisdictions do not allow these exclusions, so some of them may not apply to you.

14. Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, arising from or related to your use of the App or the Website, even if we have been told such damages are possible. Our total liability for any claim arising from these Terms, the App or the Website is limited to the amount you paid for the App and in-app purchases in the 12 months before the claim. Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, such as liability for fraud, or for death or personal injury caused by negligence.

15. Indemnification

To the extent permitted by law, you agree to indemnify and hold us harmless from any claims, damages or expenses (including reasonable legal fees) arising from your violation of these Terms or misuse of the App or the Website.

16. Additional Apple App Store Terms

If you downloaded the App from the Apple App Store, the following terms also apply. If they conflict with the rest of these Terms, these terms apply.

1. Acknowledgement. These Terms are between you and us only, not Apple Inc. ("Apple"). We, not Apple, are solely responsible for the App and its content.
2. Scope of license. Your license is a non-transferable license to use the App on Apple-branded products that you own or control, as permitted by the Usage Rules in Apple's Media Services Terms and Conditions. The App may also be accessed by other accounts associated with the purchaser through Family Sharing or volume purchasing.
3. Maintenance and support. We are solely responsible for providing maintenance and support for the App. Apple has no obligation to provide any maintenance or support services for the App.
4. Warranty. We are solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, for the App to you. To the maximum extent permitted by law, Apple has no other warranty obligation for the App. Any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are our sole responsibility.
5. Product claims. We, not Apple, are responsible for addressing any claims by you or a third party relating to the App or your possession or use of it, including: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy or similar legislation.
6. Intellectual property rights. If a third party claims that the App or your possession and use of it infringes that third party's intellectual property rights, we, not Apple, are solely responsible for the investigation, defense, settlement and discharge of that claim.
7. Legal compliance. You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
8. Developer name and address. Questions, complaints or claims about the App should be sent to us using the details in Contact Us.
9. Third-party terms. You must comply with any applicable third-party terms when using the App, such as your wireless data service agreement.
10. Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Once you accept these Terms, Apple has the right (and is deemed to have accepted the right) to enforce them against you as a third-party beneficiary.

17. Additional Google Play Terms

If you downloaded the App from Google Play, your use is also subject toGoogle Play's Terms of Service. Google is not a party to these Terms and is not responsible for the App or its content. To the extent required by applicable law, we, not Google, are responsible for the App, its support and any warranty claims relating to it.

18. Governing Law & Disputes

These Terms are governed by the laws of India, without regard to its conflict-of-laws rules. If you are a consumer, you also keep the protection of any mandatory laws of the country where you live, and you may bring a claim in your local courts where those laws allow it. Before starting a claim, please contact us so we can try to resolve the issue informally. Subject to the above, the courts of India have jurisdiction over any dispute arising from these Terms, the App or the Website.

19. Changes to These Terms

We may update these Terms from time to time. We will change the "Last updated" date above and, for material changes, tell you in the App or on this page before they take effect. Changes do not apply retroactively. If you keep using the App after a change takes effect, you accept the updated Terms. If you don't agree, stop using the App and cancel any subscription.

20. General

These Terms, together with our Privacy Policy, are the entire agreement between you and us about the App and the Website. If any part of these Terms is found unenforceable, the rest stays in effect. If we don't enforce a right, that is not a waiver of it. You may not transfer your rights under these Terms. We may transfer ours as part of a merger, acquisition or sale of assets.
